By accessing and using this website and by signing up for a course, you agree to comply with and be bound by these terms and conditions.
The terms ‘Proofreading Malta Limited’ and “us”, “our”, and “we” refer to the website owner. The term ‘you’ refers to the user or viewer of this website. However, if you are using our services on behalf of a company or other entity, then “you” means that entity and, therefore, you should have the power to enter into this Agreement on behalf of that company or entity.
The Service Provider and Client shall each individually be referred to herein as the “Party” and together and jointly referred to as the “Parties” throughout this Agreement.
Intellectual Property Rights
- All content and materials on this website, including but not limited to text, graphics, logos, brand names, course content (whether downloadable or not), style sheet, course materials, course names, resources, assessments, presentations, slides, notes, exercises, images, software, and any and all other content created and shared with you in relation to the courses (the “Content”) are the property of Proofreading Malta Limited and are protected by intellectual property laws.
- Proofreading Malta Limited reserves the rights to all its Content.
- Proofreading Malta Limited is hereby giving you the permission to access and to follow the course of your choosing for personal educational purposes. Proofreading Malta Limited is hereby granting to you, and you are hereby accepting, a non-exclusive, non-transferable, revocable licence which is limited to you in order for you to access and follow the course Content that you have registered and paid for. This is in no way to be interpreted as a transfer of rights from us to you.
- You:
- Shall not reproduce, distribute, modify, or republish any Content;
- Shall not use the Content for commercial use;
- Shall use the Content for your own personal use in accordance with the terms and conditions contained herein;
- Shall not share any of the course materials or Content with third parties;
- Shall not share any account information, including but not limited to your username and password with any other person nor may you give access to your account to any other person.
Should you wish to do any of the above prohibited activities, please contact Proofreading Malta Limited to be given the appropriate license.
Use of the Website
- You may use this website for lawful purposes only. You agree not to engage in any activity that may interfere with or disrupt the functioning of the website or its services.
- You are responsible for maintaining the confidentiality of any login credentials or accounts associated with this website. You are solely responsible for all activities that occur under your account.
- You are responsible for informing us immediately if there is any change to your personal information that was provided upon registration to the course/s.
- The website uses a third-party source for the purposes of running the technical aspects of the courses.
The course details
- The name and details of the courses are all contained on the appropriate and respective page dedicated to each course that we offer.
- The information of the awarding body of the respective course chosen by you is contained in the respective page dedicated to each course that we offer.
- The duration of each course and the total hours of learning for each course may vary from one course to another. This is why you will find the information regarding duration of each course on the respective page dedicated to each course that we offer.
- The commencement date of the courses is the date on which you begin following the course, as long as this is still available by us.
- The method of delivery of the courses shall be online.
- Some courses require your participation online by submitting coursework or answering some questions.
- The language of instruction shall be in English unless otherwise indicated on the respective page dedicated to the course.
- Each course has its own course structure and learning outcomes. For more details of this, please refer to the respective pages dedicated to each course that we offer.
- The assessment for each course is all carried out online, and is either automated or self-corrected.
- The fees charged for each course also differ from course to course. All information is contained in the respective pages dedicated to each course that we offer.
Course fees
- The course fee for the course/s of your choice is outlined on the appropriate and respective page dedicated to each course that we offer.
- It is your responsibility to pay the course fee in full before the course’s commencement date, otherwise you will not be enrolled for the course.
- The course fee includes, where applicable, the cost of electronic course notes, access to an online student area and basic course materials. Please remember that course materials and Content belong exclusively to Proofreading Malta Limited.
- By giving us your payment details when booking a course, you allow us to charge your payment account or credit card accordingly.
Cancellation and Refund Procedure
- You may exercise the right to be refunded the course fee only when:
- The course is cancelled by Proofreading Malta Limited after you would have paid the course fee and the course has not yet commenced.
- The course commencement date is delayed by Proofreading Malta Limited for more than 90 days from the stated commencement date.
- In the unfortunate circumstance that a course must be stopped by us after the course would have commenced, we will issue a partial refund. In such a case, all course Content that has not yet been utilised must be returned to us.
- You may apply for a refund by sending an email to contact@proofreadingmaltaacademy.com outlining your request.
- Should you not participate in the course after having registered and paid for it, you forfeit your right to a refund. You may however postpone your commencement date to a later date as long as the course you had registered for and paid for is still available.
User-Generated Material
- During the course, you may have the opportunity to submit or post material you have generated. By submitting or posting any such material, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, distribute, make available and display such material.
- You are solely responsible for the material you submit or post during the course. You agree not to submit any material that is unlawful, defamatory, infringing, or violates the rights of any third party.
Third-Party Links
The course or this website may contain links to third-party websites. These links are provided for convenience only, and we do not endorse or control the content of any such third-party website. Accessing third-party websites is at your own risk.
Disclaimer of Warranties
- The courses, the Content, and access to our course platform is provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, expressed or implied, regarding the website’s or the courses’ operation or the accuracy, reliability, or completeness of the website or the courses or the course Content.
- We disclaim all warranties, including but not limited to warranties of title, merchantability, fitness for a particular purpose, and non-infringement.
- The courses may be updated from time to time. In such a case, your access is solely bound to the course as it was available at the date on which it was accessed by you.
Viruses, Malware and other Malicious Software
- Electronic documents and electronic communications may from time to time be affected by malicious software such as viruses, trojans and worms (collectively ‘Malicious Software’). We shall ensure, to the best of our technical ability, that all communications sent from us, including any Content is free from Malicious Software, provided however that:
- We reserve the right to refuse any electronic file that results to be contaminated or infected with any form of Malicious Software, and to inform you accordingly.
- We shall not be held liable for any Malicious Software, or for any direct or indirect losses arising therefrom, that may be transmitted to you or to any third party, and you shall take all reasonable technical measures to ensure that all electronic communications are screened for the presence of Malicious Software.
Limitation of Liability
- In no event shall we be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use this website, and/or the course/s, even if advised of the possibility of such damages.
- Without prejudice to the provisions of this Agreement, neither Party shall be liable for delay or failure to perform any of its obligations under this Agreement insofar as the performance of such obligation is prevented by any unforeseeable cause beyond its reasonable control that is considered to be Force Majeure, as long as notification of same is communicated in writing to the other Party. Notwithstanding the foregoing, each Party shall use all reasonable endeavours to continue to perform its obligations hereunder for the duration of such Force Majeure event.
- The Parties acknowledge and accept that the delivery of the course/s may include unknown and unforeseen problems and that the Parties shall attempt to solve such problems in the best manner reasonably possible.
- You hereby acknowledge that there may be an inevitable degree of error and/or imprecision in the courses and/or the Content.
Indemnification
You agree to indemnify and hold harmless Proofreading Malta Limited, its affiliates, employees, and agents from any claims, actions, demands, losses, or damages arising from your use of the website, the course/s, or violation of these terms and conditions.
Modification and Termination
- Proofreading Malta Limited reserves the right to modify, suspend, or terminate the website or any part thereof at any time without prior notice, but after all courses have been successfully completed. Any course that is paid for but not yet commenced will, in such an eventuality, be refunded.
- Proofreading Malta Limited also reserves the right to modify these terms and conditions at any time.
- Continued use of the website, and access to course/s after any modifications to these terms and conditions shall constitute your consent to such modifications.
Data Protection & PrivacyUse of Cookies
- The Parties acknowledge and agree that due to the nature of the access to a course/s, we shall come into contact with and will be required to process your personal data as defined in the GDPR and/or personal data pertaining to any third parties that may be mentioned in the Content. Accordingly, we bind ourselves as follows:
- All personal data shall be processed in strict accordance with the GDPR and the Data Protection Act using all reasonable means available to us;
- All personal data shall only be processed for the purposes of providing the course/s, and/or all other services that may be connected, directly or indirectly, to the provision of those course/s, including the maintaining of any of your account for billing and fiscal purposes;
- No personal data that we process will be kept longer than necessary for the purposes for which it is processed. This will depend on the nature of the service that we may provide you, and in all other cases our general retention policy for any personal data processed by us is that it may be held for a maximum of ten years (10) years from the date when it was last actively used, although we shall actively seek to destroy or minimise data that has manifestly become inactive or outdated.
- All or any queries regarding any data protection or privacy matter, including any request for any amendments or updates, or any request for access to personal data, may be directed to us on contact@proofreadingmaltaacademy.com. In some cases, you or any third party making such a query may be requested to provide proof of identity before the query may be considered and addressed.
- You and/or any aggrieved third party retain the right at all times to communicate with the Office of the Information and Data Protection Commissioner www.idpc.org.mt, or any other competent Data Protection Authority that may exist within your respective jurisdiction.
Use of Cookies
- Our website uses “cookies”. A “cookie” is a piece of software, which may be sent to and stored on your computer, and which enables us to collect information about how our website is being used and to manage our site more efficiently. - to protect against abuse, misuse or unauthorised use of our website;
- to protect the personal safety or property of users of our website (e.g. if you provide false or deceptive information about yourself or attempt to pose as someone else, we shall disclose any information we may have about you in our possession so as to assist any type of investigation into your actions);
- for any purpose that may be necessary for the performance of any agreement you may have entered into with us; or
- as may be allowed or required by or under any law or legal authority.
- We do not transfer your personal information to any third parties for marketing purposes.
Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of Malta. Any disputes arising from or in connection with these terms and conditions shall be subject to the exclusive jurisdiction.
